Comelec: Filing of cases not covered by election ban

THE Commission on Elections in Central Visayas (Comelec 7) yesterday said filing of cases by the Ombudsman against public officials is not covered by the election ban.

“That (filing of case) is not prohibited,” Comelec 7 regional Director Jose Nick Mendros said, referring to the criminal charge for nepotism filed by the Ombudsman against Barili Mayor Teresito Mariñas before the Sandiganbayan.

Mariñas had questioned the timing since the complaint was filed in 2010. He said he has not yet received a copy of the case nor any communication from the Ombudsman.

The case was filed before the Sandiganbayan on March 18 this year  and raffled off to the anti-graft court’s Third Division on the same day.

“Nahibulong ko nga gi-timing og campaign period. I have yet to talk to my lawyer on this (I wonder why they timed it during the campaign period),” he said.

“Maka-suspect ta kay timing ba kay for all the years, dormant ni siya. Pwede coincidence pud (I can’t help but suspect the timing and for all the years, this case was dormant. It might have also been a coincidence),” he added.

The case was filed by a certain Kim Carmela Veloso before the Ombudsman in 2010.

Veloso accused Mariñas of violating Executive Order 292, also known as Administrative Code of 1987, when he appointed his brother Aniceto Mariñas to the position of human resource head of the municipal government in 2007.

Mariñas said he still has to consult his lawyer Rodolfo Dacalos on their legal moves.
