A complaint was filed before the Office of the Ombudsman Visayas against barangay captain Joey Edgar Camota of Tungkil, Minglanilla town in southern Cebu for violations of Republic Act 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees and Republic Act 3019 or the Anti-Graft and Corrupt Practices Act.
Complainants Dennis Solis, James Cerna and Charito Pacaña, who are constituents of Camota, claimed that the barangay captain, allegedly drunk when the incident happened, verbally harassed them and one Genesis Aba.
The three narrated in their complaint the incident last September 23 wherein Camota called the attention of Solis and Aba, who happened to pass by the barangay hall, and allegedly accused Solis of posting something on Facebook that angered him. During that encounter, the barangay captain also accused Solis’s employer, Pacaña, of being a paramour of one of his political rivals.
The same thing happened with Cerna when he went to the barangay hall later that evening wherein the barangay captain allegedly hurled the same accusation against Pacaña, also Cerna’s employer. Cerna eventually had to leave the area as Camota was getting more aggressive and “threatened (him) with his fist.”
“I was so humiliated and defamed by such allegations of respondent most especially that it was made in front of many people,” Pacaña said in his affidavit.
Solis and Cerna likewise executed separate judicial affidavits corroborating Pacaña’s allegations.
