PB Niño Boniel contests indictment

THE camp of Bohol Provincial Board Member Niño Rey Boniel has filed a motion for reconsideration to contest the latter’s indictment at the Lapu-Lapu City Prosecutor’s Office.

In a press conference yesterday, lawyer Gerardo Carillo, Boniel’s legal counsel, said that they file the motion to the panel of prosecutors on the parricide case filed against the board member.

Carillo questioned the basis of the probable cause in filing the case against his client.

“The failure of prosecutors to establish a clear probable cause because we believe there is no corpus delicti,” Carillo said.

Also, the camp of Boniel believed that the suspects turned state witnesses were forced to gave out their testimonies and affidavits.

The lawyer also said that there is no basis to charge Boniel in court, saying the testimonies of the eyewitness are not worthy of belief.

Carillo stated that the testimonies executed by Boniel’s cousin, Reolito “Etad” Boniel, are not enough to file a case against Niño.

He said that Etad has very inconsistent statements, and they believed that Etad was forced to execute an affidavit.

However, the Police Regional Office in Central Visayas reiterated that they never forced the witnesses to execute affidavits.

And their evidence and testimonials are strong to make the case stand.

The Commission on Human Rights conducted an investigation on whether the state witnesses were forced in making their testimonies.

Leo Villarino, CHR chief investigator, said that in their investigation the witnesses were not threatened to make their testimonies.
