Ombudsman affirms Gwendolyn Garcia’s dismissal, denies MR

The Office of the Ombudsman has denied the Motion for Reconsideration (MR) filed by Deputy Speaker of the House of Representatives Gwendolyn Garcia.

Former Ombudsman Conchita Morales signed the 11-page order denying the Motion for Reconsideration filed on February 19, 2018, and Supplemental Motion for Reconsideration on March 23, 2018.

“It does not appear that respondent has been prejudiced under the circumstances, considering that she was not under preventive suspension during the administrative adjudication of the case. She was even elected and re-elected as Member of Congress,” Kristine Suzanne Fineza, the graft investigation and prosecution officer III, stated in the order.

In a January 15 decision, Carpio Morales ordered the dismissal of Garcia from public office over an unauthorized, P24.47-million project to backfill a largely underwater property when she was governor of Cebu province in 2012.

“What do you expect from a retired ombudsman who has done nothing else but to persecute us, especially nasayod man ta nga suod sila nga higala ni former Chief justice Hilario Davide Jr.,” the congresswoman told reporters in a phone interview.
