CEBU CITY, Philippines–The Department of Labor and Employment in Central Visayas is asking employers to observe the compensation scheme provided for by the labor department for the midterm polls on Monday, a special non-working holiday.
Regional Director Salome Siaton of the Department of Labor and Employment said all workers, who will be reporting for work after they cast their votes, should be paid the appropriate rate applicable on that day.
The payment should be based on Labor Advisory No. 07, Series of 2019, which indicates the rules to pay wages on May 13. But if an employee does not report for work on May 13, the “no work, no pay” principle shall apply.
She said that Labor Advisory No. 07, Series of 2019 applies unless there is favorable company policy, practice or collective bargaining agreement (CBA) granting payment on a special day.
If the employee works during a special day, the worker shall be paid an additional 30 percent of his or her basic wage on the first eight (8) hours of work. For work done in excess of eight hours or overtime work, worker shall be paid an additional 30 percent of his or her hourly rate on said day.
An employee who works during a special day that also falls on his or her rest day, he or she shall be paid an additional 50 percent of his or her basic wage on the first eight hours of work.
Also, the employee working in excess of eight hours or overtime work during a special day that also falls on the worker’s rest day, he or she shall be paid an additional 30 percent of his or her hourly rate on said day.
The DOLE reminds employers to take note of the computation of wages on May 13.
