THERE won’t be a demolition of the concrete wall along W. Geonzon Street within the Cebu IT Park, Cebu City Legal Officer Jerone Castillo said last Tuesday.
Castillo said there are still legal issues that need to be clarified concerning Filinvest Land Inc.’s request for the demolition of the wall which separates their P5 billion business process outsourcing (BPO) center project from Cebu IT park.
“I will call for a conference with the Office of the Building Official (OBO), Cebu City Planning Office and the Assessor’s Office as well as the parties concerned, the Filinvest and CPVDC within this week,” Castillo said.
“I’m positive that if all parties are heard, we can get a common ground or even a compromise…we try our best to seek common ground to address all concerns of all parties so that they don’t have to go to court,” he added.
Filinvest Land Inc. (FLI) is developing the BPO center project in a province-owned lot in the area.
Delay
In its letter request to Cebu City Mayor Michael Rama, the company said the wall built by the Cebu Property Ventures Dev’t Corp. (CPVDC) hampered construction of the project.
Tristan Las Marias, Filinvest vice president for Visayas and Mindanao, said the CPVDC was already issued three notices of illegal construction by the city government for violating Section 301 of the National Building Code.
The provision states that a building permit must first be secured from the Office of the Building Official (OBO).
In its statement, CPVDC questioned why they are being blamed for the delay of the project when access to W. Geonzon St. was not committed in the Terms of the Reference of the bidding of the project.
They accused Filinvest of trying to “encroach” on their property and “gaining undue enrichment and the benefits of access to Cebu IT Park at the expense of” their locators and investors.
The CPVDC said the street will always be open to the public and won’t be closed and they only want to protect their boundaries along the existing road.
They said under their registration agreement with the Philippine Economoc Zone Authority, they have to build perimeter fences and other facilities that will physically segregate/isolate the IT Park from the rest of the adjacent area.
Rama, who referred the case to Castillo, said the two parties should resolve their differences without going to court.
