Director Arnel Tancinco of the Land Transportation Office (LTO) and two of his office heads were cleared of administrative charges filed against them by their staff.
Civil Service Commissioners said in a June 18 decision that they do not have jurisdiction to impose disciplinary action against a presidential appointee like Tancinco.
They also said that they do not find “prima facie” case against acting assistant regional director Alita Pulga and OIC Human Resources office head Lovelien Sulib that would warrant the issuance of a formal charge against them.
“Significantly too, the persons complained of were able to satisfactorily explain their side through their Joint Comments, supported by evidence,” said the five-page decision signed by CSC chairman Francisco Duque III and commissioners Robert Martinez and Nieves Osorio.
Thirteen LTO employees filed a complaint for violation of the Civil Service Law and Rules and the code of Conduct and Ethical Stands for Public Officials filed against Tancinco, Pulga and Sulib.
Complainants alleged that Tancinco signed and issued appointments orders for LTO personnel without posting the list of vacancies to be filled up in conspicuous places as required by law so other interested employees may be notified of the vacancy.
They also alleged that when vacancies were posted, posting was only made within five to 10 days.
