Garcia withdraws petition against Cebu governor, Gica

After serving his 60-day suspension, Dumanjug Mayor Nelson Garcia has decided to withdraw the civil suit he filed against Gov. Hilario Davide III and Dumanjug Vice Mayor Efren Gica.

Garcia filed a notice of dismissal of his petition for certiorari, prohibition and injunction with the Regional Trial Court in Cebu City. The case was declared moot and academic with the lapse of the period of his preventive suspension.

However, Garcia said the prohibition to hear his ongoing case and the complaint for grave abuse of authority filed against Davide, Gica and the Provincial Board are still ongoing. at bar.

Garcia, who also has a pending case before the Ombudsman for usurpation of authority, said he hopes he will be granted due process.

Governor Davide said he was  not surprised that the petition was declared moot and academic since Garcia already  served his preventive suspension.

Garcia has also filed a criminal complaint for malversation through falsification and graft against Gica for allegedly tampering with the receipt for a meal with barangay officials.

He challenged the PB to recommend preventive suspension for  Gica as well.
