Court rules in city’s favor in Citi Center case

CEBU City Hall scored another legal victory after a court dismissed the civil case filed by occupants of the Citi Center Complex in barangay Kamagayan.

Regional Trial Court (RTC) Judge Soliver Peras of Branch 7 said the petition for certiorari, prohibition and mandamus is already moot since the demolition of Citi Center is an accomplished fact.

“The Supreme Court ruled that when the events sought to be prevented by injunction or prohibition have happened, nothing more could be enjoined or prohibited,” Peras said in his order dated June 1.

At least 72 families affected by the Citi Center demolition went to court in September last year to seek a halt on the demolition of their complex because they weren’t consulted.

The city government, which owns the property, is planning to build a medium-rise residential building in the area for City Hall employees.

Right now, the area is temporarily being used as a parking area. Sought for comment on the decision, Mayor Michael Rama welcomed the decision.

He said the city wanted also to demolish the property since it has become an area for illegal activities like drugs and prostitution.
