THE Associated Labor Unions (ALU) will file a second motion for reconsideration on the Supreme Court ruling that affirmed former senator Ernesto Herrera’s assumption as president of the Trade Union Congress of the Philippines (TUCP).
“We haven’t received a copy of the Supreme Court decision but we’ll file the motion anchored on the fact that the decision was not based on the merits once the copy of the decision will be officially received,” ALU lawyer Jonas Asis said.
“The Supreme Court ruling was a technicality because they said we didn’t attach certified true copy but there was an attachment,” Asis said.
On June 16, 2014 the Court of Appeals (CA) ruled that Herrera became president of the TUCP when then president Democrito Mendoza resigned from his post.
Based on Associate Justice Noel Tijam’s October 20, 2013 decision, the TUCP presidency remained vacant following Mendoza’s resignation on November 1, 2011. Asis said even when Mendoza resigned from his post, he still performed his functions as president of the ALU-TUCP group.
Herrera, then secretary-general of the TUCP, filed a complaint before the Bureau of Labor Relations. The BLR then ordered a status quo and convened a meeting among TUCP members to resolve the issue on leadership.
