Cebu City Mayor Michael Rama and Vice Mayor Edgardo Labella has asked the Commission on Elections (Comelec) to dismiss the election protests filed by their opponents in the 2013 elections.
In a June 25 motion to dismiss, Rama and Labella’s counsel Lyle Surtida said Tomas Osmeña and Joy Augustus Young failed to submit a formal offer of exhibits to them within the allowed period of time.
The marking of exhibits was terminated last June 18 and within five days from then, the offer of exhibits should have been given to Rama and Labella’s counsel. But Surtida said they haven’t received the formal offer which violates the order coming from Comelec.
“Such failure of the protestants to personally furnish the protestees with their respective Formal Offer of Exhibits should also be deemed a waiver of the former’s right, for which reason the Commission should dismiss the respective election protest filed by the protestants against the protestees,” they said in their motion.
