Digitel gets 72-hour reprieve

The Regional Trial Court (RTC) has issued a 72-hour temporary restraining order (TRO) against the Cebu City government to stop the removal of a cell site tower in Sitio Calvary Hills in Barangay Apas in Cebu City.

Executive Judge Soliver Peras of the Cebu City RTC said the order was issued to prevent further damage to the right of Digitel Mobile Philippines Inc. (DMPI), commercially known as Sun Cellular.

“This court is of the opinion that there exist an impending and imminent threat on the property of the plaintiff (Sun Cellular) guaranteed by the constitution and that there would result a grave and irreparable injury to the plaintiffs and its subscribers,” said Peras’ order.

A hearing on whether or not to extend the TRO will be conducted.

DMPI, through its lawyers Eduardo Felipe and Diosadado Trillana, on Tuesday sought the court’s intervention after the city government issued separate closure orders against Sun Cellular and Globe Telecom for their cell sites in the area.

The City Council earlier revoked the special permits issued to the two companies following complaints that their cell site towers were causing cancer among Sitio Calvary residents.
