Department of Interior and Local Government (DILG) Provincial Director Jerome Gonzales revealed that the dismissal order will be served against Aloguinsan Mayor Augustus Caesar Moreno once they receive a copy from the Office of the Ombudsman.
But Gonzales explained that Moreno can still contest the order as there are still legal remedies available to him.
Moreno said, “The dismissal order can be avoided by filing a TRO (temporary restraining order), but I’m not interested that’s why I resigned.”
Instead, he filed a motion for reconsideration two weeks ago to contest the ruling, which can still be reversed.
Moreno officially vacated his position in favor of his son, Vice Mayor Ignatius Caesare Moreno, after Gov. Hilario Davide III accepted his resignation on Wednesday.
He cited personal problems in his resignation letter.
But despite having resigned, Gonzales said the DILG will still serve a copy of the dismissal order on Moreno.
To recall, the Office of the Ombudsman has dismissed from service Aloguinsan Mayor Moreno and four other municipal employees who are members of their Bids and Awards Committee after they were found guilty of grave misconduct.
Former Vice Mayor Cynthia Moreno was also included in the order since the incident happened while she was serving her term.
Their dismissal and indictment stemmed from allegations that they violated criminal and administrative laws for awarding transactions to AVG Bakeshop amounting to P282,725 despite the fact that the Morenos own the bakeshop.
