Families in Capitol site lot seek stay in demolition

The houses of 160 families along Don Gil Garcia St. in barangay Capitol Site, Cebu City are scheduled for demolition by the sheriff of the Regional Trial Court tomorrow.

The group of residents filed a motion to exclude themselves from a March 27 demolition order issued by RTC Branch 19 Judge Wilfredo Navarro for 283 families in the area.

The residents claim that they are no longer included in the lot owned by heirs of Mauricio Quijada who requested the court for the demolition.

Mapranillo Vergara, president of the occupants said they hope the RTC will act on their motion and issue a Temporary Restraining Order within today or tomorrow.

He said the court sheriff should hold in abeyance the demolition since there is also a scheduled technical conference between the residents and the lot owner with the Department of Environment and Natural Resources (DENR) 7 on July 7.

Vergara said the residents have already applied for a free patent for the lots which they say is a public land.
