“That I am the complainant who sought the assistance from the NBI against one CHERLEYVENIA GAVIOLA FERNANDEZ, the present Administrative Officer V of National Commission on Muslim Filipinos – Visayas whom I dealt with in connection with our availment of age and height waiver relative to my application for employment with the Bureau of Fire Protection-7;”
“That the NBI had endeavored to summon Fernandez where I was given the chance to discuss with the former the differences that prompted me to file the complaint of possible irregularity on her part;”
“That upon advice of family and close friends, manifest my intention to desist in prosecuting Fernandez for the reason that my meager financial situation could ill afford to sustain a long-drawn trial in the event the case reaches the court. Further, out of pity and compassion considering the long service employment record of Fernandez in the government and considering further her frail health, these factors further gave my resolve to forgive her . Further, we came to agree that my complaint was borne out of miscommunication and we resolve to correct the same;”
“That in connection therewith, I make manifest my voluntary declaration that I am withdrawing my complaint against Fernandez and hereby request the NBI not to pursue their investigation or criminal complaint, if any. In the event that there was already a case filed, I request that the same be withdrawn for lack of legal and factual basis;”
“That this desistance was arrived out based purely from the above mentioned reason on my own volition without any force or intimidation on the part of Fernandez”.
