Man acquitted of raps

A MAN, who was arrested during a drug raid and charged in court for visiting a drug den and possessing illegal drugs, was acquitted of the charges filed against him last Friday.

Judge Mory Nueva of the Regional Trial Court Branch 13 in his decision said the prosecution failed to prove the guilt beyond reasonable doubt of accused, Avelino Laborte, after they failed to prove that the house where Laborte was arrested was a drug den.

The prosecution also failed to prove that the alleged packets of shabu taken from Laborte were genuine.

Laborte was arrested during a Jan. 31, 2011 police raid in a house in Barangay Duljo-Fatima, Cebu City, where an alleged drug session was taking place. Three packs of suspected shabu were allegedly recovered from Laborte after a body search.
