Davide, officials ask for extension from court

CEBU Gov. Hilario Davide III and seven other provincial government officials asked the court to give them until Oct. 17 to submit their affidavits to the case filed by a losing bidder for medical supplies and equipment.

Late last month, the provincial government received a copy of an Aug. 15 order issued by Regional Trial Court Branch 18 judge Gilbert Moises directing them to respond to a petition filed by Manila-based firm Endure Medical Inc. (EMI) against them.

Judge Moises’ order stemmed from the petition filed by EMI back in August in connection to the bidding for the purchase and supply of medical equipment for the province’s district hospitals.

Also named as respondents in EMI’s petition are the 12 winning bidders for medical supplies.

EMI asked the court to nullify the Bids and Awards Committee’s decision that declared them ineligible to join the bidding.

EMI was declared ineligible for failure to submit at least one form of bid security in addition to the bid securing declaration during the bid opening held in May 5, 2015.

EMI filed a motion for reconsideration that was denied by the province’s Bids and Awards Committee.

EMI insisted that as a bidder, it has the option of submitting only a bid security declaration as a bid security.
