ARCHIVAL SLAY: Cops given chance to stop arrest order

The trial court in Argao town has scheduled an oral argument to determine whether or not there is sufficient basis to order the arrest of the three policemen who were implicated in the ambush-slay of lawyer Noel Archival and companions.

In an order, Judge Maximo Perez granted the request of defense lawyer Inocencio de la Cerna Jr. to conduct a hearing on Oct. 2, so that Senior Insp. Joselito Lerion, Senior Supt. Romualdo Iglesia, and PO1 Alex Bacani can prove that there is not enough evidence to hold them for trial.

De la Cerna said he may present Lerion in court in an attempt to have the charges against all the accused dismissed.

Lerion, Iglesia, and Bacani were earlier indicted by Prosecutor Rodrigo Taga-an on charges of multiple and frustrated murder.

No bail was recommended for the three policemen of the Highway Patrol Group.

“We can prove that these three policemen were in Cebu City when Atty. Archival and companions were ambushed in the Municipality of Argao,” said De La Cerna in an interview yesterday.

He said they will present certifications and affidavits of witnesses to prove their claims.

While the defense of the accused are mere alibi, De La Cerna said that their evidence are “substantive and heavy.”
