The Sandiganbayan’s First Division dismissed the graft case filed against Dalaguete Mayor Ronald Cesante for the Ombudsman’s failure to investigate the case for “unreasonably long period of time.”

In resolving the mayor’s motion to quash, the Sandiganbayan pointed out that the Ombudsman is required to act promptly on all complaints filed in their office.

It said the Ombudsman’s unreasonable delay in handling Cesante’s case has violated his constitutional right to speedy disposition of his case and thus should be dismissed.

Cesante’s case stemmed from the approval of lease contracts of commercial units involving his wife back in 2007.
