Mayor Garcia threatens to sue Davide, PB for suspension order

Dumanjug Mayor Nelson Garcia threatens to sue Cebu Gov. Hilario Davide III and The Provincial Board if they enforce the suspension order they issued on him.

Garcia, who’s represented by his father former congressman Pablo Garcia, said the recommendation has no legal basis and the PB’s Committee on Complaints and Investigation didn’t follow procedures in hearing the administrative case against him.

He was also never summoned to a hearing, Garcia said. An administrative case was lodged against him by Dumanjug Vice Mayor Guntrano “Gungun” Gica last year after he allegedly appointed Emmylou Cabonilas as municipal secretary.

Garcia said he already filed an administrative and criminal complaint against the PB committee before the Ombudsman for their alleged failure to respond to a separate administrative case he filed against Gica last January.

He said the recommendation to suspend him is politically motivated. Davide is still in Manila and has yet to act on the board’s recommendation.
