Dumanjug town mayor’s suspension up to Davide

It’s the governor’s call, according to Cebu Provincial Board Member Arleigh Sitoy.

He said it’s up to Gov. Hilario Davide III to act on the Provincial Board’s recommendation to place Dumanjug Mayor Nelson Garcia on preventive suspension for 60 days.

He said they will wait for Davide’s decision since they forwarded the recommendation to him last March 24.

Garcia has filed an appeal with the PB.

Sitoy, head of the complaints and investigation committee, said their role is only recommendatory and it’s the governor who has the power to suspend.

Davide earlier made it clear that he wants the PB to act on Garcia’s motion for reconsideration first before he makes a decision.

“As a matter of procedure, we will wait for his word because the paper is already with him. The decison now lies with him,” Sitoy told Cebu Daily News.

Garcia has countered with a number of petitions aside from filing a motion for reconsideration.

He also asked to disqualify members of the PB complaints and investigation committee for showing “political bias.”

The PB the other week voted to approve the recommendation of the committee to impose a 60-day preventive suspension while his usurpation of authority case is being resolved.

The case stemmed from Garcia’s appointment of the municipal council secretary, a power that is exclusive to the vice mayor according to Vice Mayor Guntrano Gica.
