Driver of CPDRC vehicle free from liability

NO CHARGES will be filed against the driver of the service vehicle of the Cebu Provincial Detention and Rehabilitation Center (CPDRC) which figured in an accident in Sibonga town, southern Cebu last Monday morning.

PO3 Herbert Pananganan, investigator of Sibonga Police Station, said what happened was beyond the control of Roberto Creer since the accident was caused by mechanical error.

Creer had told police that the vehicle’s brakes malfunctioned while he was negotiating a slight curve along the national highway in barangay Bahay.

Creer said he decided to swerve the vehicle to the right side of the road to avoid hitting a car and a trisikad in front and rammed into a tree instead.

The vehicle, boarded by 15 inmates and five jail personnel, then fell on its side.

“If we try to look at it, no other vehicles were involved in the accident. And how will you manage to brake if the rubber cap have already exploded. In Creer’s situation he tried to mend the situation by ramming it to a tree,” said Pananganan in Cebuano.

In the accident, two out of the 15 inmates were wounded while the rest complained of severe body pains.

The jail guards were unhurt.

Marco Toral, Capitol consultant on jail matters told Cebu Daily News, they will not press charges against the driver.

Despite the accident, then inmates went to attend their court hearings in Argao town.

He admitted that the vehicle used in transporting the inmates to attend their court hearings is already too old.

“The vehicle has been of service for 25 years to CPDRC, we will slowly fix it,” he said.
