Palace reverses order on Garcia

Suspended Dumanjug Mayor Nelson Garcia won’t assume office at least until after six months.

Last Monday, the Office of the President issued a resolution reversing and setting aside its previous order dated July 25, 2015.

“After a careful evaluation of the records, this Office reconsiders its June 25, 2015 order and finds that staying the execution of the (Provincial Board) resolution pending this appeal is not of extreme urgency,” the resolution reads.

The resolution was signed by Executive Secretary Paquito Ochoa Jr. with the authority of the President.

Earlier this month, Garcia insisted that he can resume his post as mayor based on an order from the OP issued last June confirming that his appeal before the office stays the execution of his suspension.

The latest resolution from the OP states that a stay order is issued only if the matter is of extreme urgency that grave injustice and irreparable injury would arise unless issued immediately.

Cebu Gov. Hilario Davide III earlier suspended Garcia for six months based on  the Provincial Board’s recommendation after he was found guilty of grave abuse of authority for bypassing the municipal council by appointing the council secretary.
