Woman sues driver of armored car that hit her
A woman is seeking at least P2.5 million in damages after an armored car allegedly hit her, causing serious injuries on her body, especially her leg.
Luz Fegarido, of Barangay Lahug, Cebu City, filed a case before the Regional Trial Court against Elmer Simacon, the driver of the armored car, and his employer, Cebu Mandarin Security Services Inc.
In her complaint, Fegarido said the incident happened on November 13, 2015 when the armored car driven by Simacon hit her as she was walking along the highway at corner P. del Rosario and Pelaez Streets.
“As a result, plaintiff (Fegarido) suffered very serious injuries on her body, especially her legs,” her complaint reads. She also said in her complaint that she also suffered loss of income as she was not able to work as a result of the incident.
Fegarido said “there was no interest on the part of the defendants to settle their obligation” during the mediation proceedings and ignored her request for extrajudicial settlement, prompting her to go to court.
She added that she had been in and out of the hospital for almost a year and underwent several operations.
Due to the incident, Fegarido is seeking at least P1 million in moral damages, P1.5 million for actual expenses, P50,000 for exemplary damages, P50,000 for attorney’s fees and P2,000 for appearance fee per hearing.
