CEBU CITY, Philippines – A 44-year-old man died in the hospital a day after his motorcycle collided with a van in an intersection in Barangay Looc, Mandaue City.

The incident transpired at around 1:35 p.m. on Thursday, Oct. 12, at the intersection of Plaridel and G. Ouano Streets in Barangay Looc, according to the police report.

The motorcycle driver was identified as 44-year-old Joseph Acuña, a resident of Mabolo Compound in Barangay Alang-Alang, Mandaue City.

In its initial investigation, the Traffic Enforcement Unit of the Mandaue City Police Office (MCPO), said that Acuña was traveling along G. Ouano Street on his way to Barangay Looc when the accident that caused his untimely death happened.

The van that was driven by 25-year-old Lyndon Rodriguez Batoon of Sampaguita Street in Barangay Tejero, Cebu City was traveling along Plaridel Street on his way to Cebu City.

MCPO’s report said that the collision happened in front of a bakeshop located at the intersection of G Ouano and Plaridel Streets.

Due to the impact of the collision, Acuña fell on the pavement and sustained injuries.  He was immediately brought to Mandaue District Hospital, located just a few meters away from the accident site.

At the police station, Batoon reportedly admitted that he was at fault for hitting the motorcycle.  He made a promise to shoulder Acuña’s hospital bills and the repair of his motorcycle.

But Acuña died the next day, Friday, due to the injuries that he sustained.

Still, his wife made a decision to no longer charge Batoon and instead reach an amicable settlement with him, the police said.

The victim’s wife has decided not to file charges against Batoon after he agreed to a settlement fee of P300,000. Batoon was released from police custody after he made an initial payment of P50,000.
